Interior Ministry approves new regulation for patents for foreigners: up to 10 working days

On 17 September 2026 the Ministry of Internal Affairs of Russia officially published Order No. 322 of 22.05.2026 approving the Administrative Regulation for the state service "Processing, issuing and reissuing a patent to foreign citizens and stateless persons, as well as issuing a duplicate, cancelling a patent and amending the information in a patent". The order was registered by the Ministry of Justice on 17.09.2026 under No. 88302 and enters into force 90 days after the day of its official publication, that is, in mid-December 2026.

What has changed

The previous regulation approved by Interior Ministry Order No. 695 of 05.10.2020 is repealed. The new document describes the whole patent cycle in one procedure: processing and issuing, reissuing, issuing a duplicate, amending the information in the patent and cancelling it.

Terms and state fee

• The maximum time for the service is 10 working days.
• A state fee is charged in the amounts set by subparagraphs 27 and 28 of paragraph 1 of Article 333.28 of the Tax Code.

Who it affects

Foreign citizens and stateless persons aged 18 and over who came to Russia visa-free and work or plan to work under a patent, as well as their employers and clients. The patent system does not apply to citizens of the EAEU countries.

What to do

• If you are applying for a patent or reissuing one at the end of the year, keep in mind when the new regulation takes effect: 90 days after the official publication on 17.09.2026.
• Check your set of documents against the requirements of the migration unit before filing: mistakes in documents are a common reason for refusal and a repeat visit.
• Keep the state fee receipts and have your passport and migration card at hand: the application will not be accepted without them.
